Terms of Service

These Terms of Service ("Terms") govern your use of BetterReviews ("the Service"), a Shopify app operated by Daniel Studzinski ("we", "us", "our"). By installing or using the Service, you agree to these Terms.

1. Service Description

BetterReviews is a product review platform for Shopify stores. The Service enables merchants to collect customer reviews via AI-powered conversations and email requests, display reviews on product pages, and analyze review performance.

2. Eligibility

You must have an active Shopify store to use BetterReviews. You must be at least 18 years old or the age of majority in your jurisdiction.

3. Account Responsibilities

• You are responsible for maintaining the security of your Shopify account and API credentials.
• You are responsible for all activity that occurs through your account.
• You must not share your store-specific API keys with unauthorized parties.

4. Acceptable Use

You agree not to:

• Use the Service to collect, store, or process data in violation of applicable laws
• Submit fake or misleading reviews
• Attempt to access data belonging to other merchants
• Interfere with the operation of the Service
• Reverse engineer or attempt to extract source code from the Service

5. Data Processing

When you install BetterReviews, you authorize us to process customer data as described in our Privacy Policy. You are responsible for ensuring your use of the Service complies with applicable privacy laws, including providing any required notices to your customers.

6. Review Content

• Customers retain ownership of their review content.
• By submitting a review, customers grant both the merchant and BetterReviews a non-exclusive, royalty-free license to display, reproduce, modify (for formatting), and analyze the review content.
• Reviews may be processed by AI for quality assessment, sentiment analysis, spam detection, and content moderation.
• AI may guide the review conversation interactively to help customers write more detailed, useful reviews.
• Merchants may moderate, approve, or reject reviews. Rejected reviews are not publicly displayed but may be retained for compliance purposes.
• Customers can request review removal by contacting the merchant or by emailing support@betterreviews.app.
• We may use anonymized, aggregated review data to improve our AI models and Service quality.

7. End User Terms

This section applies to customers who submit reviews through BetterReviews on a merchant's Shopify store.

• Your review may be published publicly on the merchant's product pages.
• AI may guide the review conversation interactively and analyze your review content for quality and moderation purposes.
• By submitting a review, you grant both the merchant and BetterReviews a non-exclusive, royalty-free license to display, reproduce, modify (for formatting), and analyze your review content.
• You may request removal of your review by contacting the merchant or by emailing support@betterreviews.app.
• You must be at least 13 years old to submit a review.

8. Subscription and Billing

• BetterReviews is billed through the Shopify App Store billing system.
• Subscription plans and pricing are displayed in the app and on our website.
• You may cancel your subscription at any time through the Shopify admin.
• Refunds are handled per Shopify's standard refund policies.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications to the Service. We will provide reasonable notice for planned downtime when possible.

10. Data Retention and Deletion

Upon uninstallation of the app, we will delete all store data within 30 days as required by Shopify's mandatory GDPR webhooks. See our Privacy Policy for complete data retention details.

11. Limitation of Liability

To the maximum extent permitted by law, BetterReviews shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities.

12. Indemnification

You agree to indemnify and hold harmless BetterReviews from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the app dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator resides, without regard to conflict of law provisions.
