Terms of Service

These Terms of Service ("Terms") govern your use of BetterReviews ("the Service"), a Shopify app operated by BetterReviews Daniel Studziński, a sole proprietorship registered in Poland with a registered address at al. Solidarności 68/121, 00-240 Warsaw, Poland ("we", "us", "our"). By installing or using the Service, you agree to these Terms.

1. Service Description

BetterReviews is a product review platform for Shopify stores. The Service enables merchants to collect customer reviews via AI-powered conversations and email requests, display reviews on product pages, and analyze review performance.

2. Eligibility

You must have an active Shopify store to use BetterReviews. You must be at least 18 years old or the age of majority in your jurisdiction.

3. Account Responsibilities

  • You are responsible for maintaining the security of your Shopify account and API credentials.
  • You are responsible for all activity that occurs through your account.
  • You must not share your store-specific API keys with unauthorized parties.

4. Acceptable Use

You agree not to:

  • Use the Service to collect, store, or process data in violation of applicable laws
  • Submit fake or misleading reviews (see our Fraud and Spam Prevention Policy for our enforcement approach)
  • Attempt to access data belonging to other merchants
  • Interfere with the operation of the Service
  • Reverse engineer or attempt to extract source code from the Service
  • Remove, hide, or obscure the "Powered by BetterReviews" attribution while your store is on the Free plan (see Section 8a)

5. Data Processing

When you install BetterReviews, you authorize us to process customer data as described in our Privacy Policy. You are responsible for ensuring your use of the Service complies with applicable privacy laws, including providing any required notices to your customers.

6. Review Content

  • Customers retain ownership of their review content.
  • By submitting a review, customers grant both the merchant and BetterReviews a non-exclusive, royalty-free license to display, reproduce, modify (for formatting), and analyze the review content.
  • Reviews may be processed by AI for quality assessment, sentiment analysis, spam detection, and content moderation.
  • AI may guide the review conversation interactively to help customers write more detailed, useful reviews.
  • Merchants may moderate, approve, or reject reviews. Rejected reviews are not publicly displayed but may be retained for compliance purposes.
  • Customers can request review removal by contacting the merchant or by emailing [email protected].
  • We may use anonymized, aggregated review data to improve our AI models and Service quality.

7. End User Terms

This section applies to customers who submit reviews through BetterReviews on a merchant's Shopify store.

  • Your review may be published publicly on the merchant's product pages.
  • AI may guide the review conversation interactively and analyze your review content for quality and moderation purposes.
  • By submitting a review, you grant both the merchant and BetterReviews a non-exclusive, royalty-free license to display, reproduce, modify (for formatting), and analyze your review content.
  • You may request removal of your review by contacting the merchant or by emailing [email protected].
  • You must be at least 13 years old to submit a review.

8. Subscription and Billing

  • BetterReviews is billed through the Shopify App Store billing system.
  • Subscription plans and pricing are displayed in the app and on our website.
  • The monthly subscription price in effect when a store subscribes applies for the life of that subscription. Optional usage charges (such as Fair auto-recharge credit blocks, which are opt-in and capped by a merchant-set monthly limit) are billed in addition to the subscription price and are not covered by this price lock. Plan price changes apply only to new subscriptions.
  • You may cancel your subscription at any time through the Shopify admin.
  • Refunds are handled per Shopify's standard refund policies.

8a. The Free plan

The Free plan is offered at no charge and requires no subscription. It currently includes review collection through the classic review form, review request emails, the display widgets, syndication feeds, moderation, review analysis (a full analysis pass on reviews you collect through the Service, and a lighter pass on reviews you import, subject to a per-store allowance), the weekly digest, import and export, and API access. We do not meter or charge on your order, review, or review-request volume on any plan.

Operational limits. Outbound sending is paced to protect deliverability, and we apply operational limits in good faith to protect the security, availability, and sending reputation of the Service. These limits apply on every plan, paid and free, and are not a charge or a quota you can exceed into a bill.

Branding condition. On the Free plan, a "Powered by BetterReviews" attribution is displayed on the review widgets, the review form, the customer review hub, and the emails we send on your behalf. It is a vendor attribution: a line of text and a link to our website, carrying no offer, discount, or purchase call to action. Keeping that attribution visible is a condition of using the Free plan. Removing, hiding, or obscuring it — including through custom CSS or theme code — is not permitted on the Free plan. If it is removed, hidden, or obscured, we may restore it, withdraw the Free plan for that store, or suspend the Service for that store. The attribution can be turned off on a paid plan.

AI conversation allowance. The Free plan includes a total of 50 AI-guided review conversations per store, counted across both shopper-facing conversations and merchant playground conversations. This is a one-time lifetime allowance, not a monthly one. Once it is used, review collection continues on the classic review form and nothing stops; AI conversations resume if you subscribe to a paid plan.

Fair use. The Free plan is intended for ordinary use by a Shopify store collecting reviews from its own customers. We may apply volume limits to, suspend, or withdraw a Free plan account that is used abusively — including to send unsolicited or promotional email, to generate artificial review or email volume, or in any way that threatens the deliverability, security, or availability of the Service for other merchants. Where practical we will notify you before acting, and the paid plans remain available.

Except as set out above, the Free plan confers no entitlement to features reserved for paid plans (including AI review conversations beyond the allowance, the Studio and Insights surfaces, product-page AI content, claims and rights management, and attribution removal). The feature list above describes the Free plan as it stands today and may change; we will communicate material changes as described in Section 13.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications to the Service. We will provide reasonable notice for planned downtime when possible.

10. Data Retention and Deletion

Upon uninstallation of the app, we will delete all store data within 30 days as required by Shopify's mandatory GDPR webhooks. See our Privacy Policy for complete data retention details.

11. Limitation of Liability

To the maximum extent permitted by law, BetterReviews shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities.

12. Indemnification

You agree to indemnify and hold harmless BetterReviews from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the app dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms. Changes to these Terms do not affect the subscription price lock described in Section 8; the price in effect when you subscribed continues to apply to your existing subscription.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator resides, without regard to conflict of law provisions.
